HEALTH CARE BENEFITS FOR INDIVIDUALS EX- 3 POSED IN UTERO TO CONTAMINATED WATER 4 AT CAMP LEJEUNE, NORTH CAROLINA. 5 (a) ELIG1BILITY FOR BENEFITS -The Secretary of 6 Veterans Affairs shall provide each ind,ividual described in 7 subsection (b)! with such health care as the Secretary de- June 15.2006 0: \ARM\ARMO6B86.LC S.L.C. 2 1 termines is needed by such individual for any health prob- 2 lem, condition, or disability that is associated with the ex- 3 posure of such individual as described in that subsection 4 (b) COVERED INDIVIDUALS. -An individual described 5 in this subsection is any individual, as determined by the 6 Secretary of Defense in consultation with the Agency for 7 Toxic Substances, who was exposed in utero to water con- 8 taminated with toxic chemicals at United States Marine 9 Corps Base Camp Lejeune, North Carolina. 10 (c) AUTHORITY FOR CARE To BE PROVIDED DI- 11 RECTLY OR By CONTRACT -The Secretary may provide 2 health care under this section directly or by contract or 13 other arrangement with a health care provider. 14 (d) CONSTRUCTION .Nothing in this section shall be 5 construed to affect the rights or obligations of any person 16 or entity, including the Federal Government, under any 17 other law. 8 (e) NOTICE ON EXPOSURE 19 (1 NOTICE REQUIRED. .The Commandant of 20 the Marine Corps shaJl, upon completion of the re- 21 port by the Agency for Toxic Substances Disease 22 Registry on human exposure to contaminated drink- 23 ing water at Camp Lejeune, take appropriate actions 24 to notify each person who may have been exposed to 25 such drinking water of such exposure. June 15.2006 0: \ARM\ARMO6B86.LC 3 ELEMENTS.- 1 (2) -The notice provided under 2 paragraph (1 shall include the following: 3 (A) A description of the events resulting in 4 exposure to contaminated drinking water at 5 Camp Lejeune. 6 (B) A description of the duration and ex- 7 tent of the contamination of drinking water at 8 Camp Lejeune 9 (C) The known and suspected health ef- 10 fects of exposure to the contaminants in the contaminated drinking water at Camp Lejeune. 12 (D) A description of sources of additional 13 information on 4 (i) the contaminated drinking water at Camp Lejeune; and 5 (ii) the known and suspected health 6 17 effects of exposure to the contaminants in 18 such drinking water, 19 (f) HEALTH CARE DEFINED.-In this section, :" has the meaning given that term in 20 term "health care of title 38, United States Code. section 1803(c)(1 21 June 15.2006
